Ukraine is one of few happy countries where the surrogate motherhood is authorized. Point 2 of article 123 of the Family code of Ukraine accurately regulates the parental rights concerning the child born as a result of the surrogate motherhood program. According to given article the married couple that conceived the child has parental rights. Surrogate mother cannot have parental rights concerning such a child.
The reproductive right is the right to continue in other person, the right to give the beginning to a new life. It is natural and integral right of each person. It would be wrong to deprive of this right only because a person has problem with health. If to speak about surrogate motherhood, treatment by the given method is prescribed to couples where woman can conceive the child, but by the state of health cannot bare him. Thus, the child, born by surrogate mother, has a genetic relation only to couple that conceived him and has no relation to surrogate mother. Therefore it is completely logical, that Ukrainian legislators in norm of the Family code of Ukraine have fixed the parental rights to pair who conceived the child. This is logical, wise, and the main humane decision of the Ukrainian members of parliament. Thanks to it, in Ukraine the natural and integral right of every person to continue his generation (reproductive right) is not broken.
Point 3 of article 123 of the Family code of Ukraine stipulates the right of the married couple to take advantage of egg donation service.
All medical moments connected with the programs of surrogate motherhood the Order № 771 of Ministry of health protection of Ukraine from 23.12.2008 regulates.
The contract between intended parents and surrogate mother concerns civil-law contracts and is regulated by norms of the Civil code of Ukraine. Actually it is the contract on rendering of services.
